In testimony before the Senate Intelligence Committee, BI Director Christopher Wray stated that TikTok's Chinese ownership raises concerns about the potential for the Chinese government to access user data, calling it a 'national security concern.' He noted that the app's data collection practices, including location and behavioral data, could be exploited by Beijing, supporting the pro-argument that the ban is a legitimate security measure rather than a free speech issue.
Internal TikTok documents, reviewed by The Intercept, showed that the app collected extensive user data, including 'state of mind' and 'personality traits,' beyond what is necessary for a video-sharing platform. This data, stored on servers accessible to ByteDance employees in China, raised alarms about potential access by Chinese authorities, reinforcing the pro-argument that TikTok functions as a surveillance tool disguised as an entertainment app.
TikTok invested heavily in Project Texas, a $1.5 billion plan to store US user data on Oracle servers and implement independent audits, to address national security concerns. However, US officials, including lawmakers, argued that the measures were insufficient because ByteDance's algorithms and content moderation systems remained under Chinese control, highlighting the con-argument that the ban is a moving target and that TikTok has made good-faith efforts to comply with US demands.
The American Civil Liberties Union (ACLU) filed an amicus brief arguing that a TikTok ban would violate the irst Amendment rights of 170 million US users, as it would restrict access to a platform used for political expression, education, and community building. The brief emphasized that the government has not provided public evidence of TikTok handing data to the Chinese government, framing the ban as a protectionist attack on a popular app rather than a legitimate security measure, supporting the con-argument.
